adel,

Yes it's possible. And dapat yung dalawang employee ang ma-investigate. And sanction if proven.

Sir Patrick,

I went to CEBU last April 19 - 21, 2010 for a training program, I'm not informed that along with the training there will be a bond, but when we arrived last april 21st my immediate sup told me that there is a bond after the training in which I am not informed before I left for CEBU. I didn't signed the contract, my ground is I am not informed that there is a bond after the training. I filed my resignation and the company accepts it, but they told me that I need to pay the training bond for the training expenses. The grounds of our Admin.Head is the company had invested something.

The training bond had been given to me last July 29, 2010, in which it's 2 months after I went back from the training. It indicates there that I will be rendering a year of continuous service to the company.

Will it be justifiable that I will pay for the Training Expenses (transportation, lodging, etc.)?
If i will not pay the said training expenses, can I be sued with breach of contract?

"Backpay" in the common usage refers to unpaid salaries, pro-rated 13th month, tax refund, leave conversion (if any).

The issue on "number of years served multiplied by basic salary" is retirement benefit - which is not required by law except for those who reach at least 60 years old AND have worked for the company for at least 5 yrs. If your company has a similar or better benefit for employees even below 60 yrs old, then it should be implemented.

khristian,

What is the company policy for resignation? How many days in advance? The Labor Code requires 30-days notice in advance.

Your clearance and final pay may be delayed if you don't complete what is required by law or company policy.

Santy Karlo,

Normally once a contract ends, there is no need for any further advise. You just don't report the day after.

If you still continue working, you are assumed to be a regular employee already.

For resignation, the minimum benefit you can get is - unpaid salaries, pro-rated 13th month, and tax refund.

Chris,

What case did you file with NLRC? You might not be cleared yet until the matter is resolved.
